These terms apply to the FitSpotd website (fitspotd.com) and its waitlist. By using the website, you agree to them. These terms are also available in French. Terms for the FitSpotd app will be published before it launches. FitSpotd is currently offered only in Canada and the United States.
1. The waitlist
Joining the waitlist is free and doesn't oblige you to anything. It doesn't guarantee that FitSpotd will launch, when it will launch, or which features it will have. FitSpotd is in development, and the features described on this website may change. We may end the waitlist at any time; if we do, we will delete the waitlist information as described in our Privacy Policy.
The waitlist is for people 13 and older (14 and older in Quebec, Canada). We may remove a signup that breaks these terms, for example one made with someone else's email address or by a bot.
2. Using the website
You agree not to:
- sign up someone else without their permission, or use a fake or temporary email address;
- use bots or automated tools to sign up, or to access, copy or scrape the website in bulk;
- try to disrupt, overload, or gain unauthorized access to the website or our systems.
3. Our name and content
The FitSpotd name, logo, and the content of this website belong to FitSpotd. You may share links to the website, but you may not copy or reuse our logo or content to represent another product or service.
Brand names and logos mentioned on this website belong to their owners. FitSpotd is not affiliated with, endorsed by, or sponsored by those brands unless stated.
4. Your ideas and feedback
If you send us ideas, suggestions or feedback, you agree that we may use them to improve FitSpotd, without any obligation to you, including payment or credit. Please don't send us anything you want to keep confidential.
5. Links to other websites
This website may link to other websites. We are not responsible for their content or practices.
6. Your rights as a consumer
Nothing in these terms limits or excludes rights you have under the Consumer Protection Act (Quebec) or any other law that cannot be limited or excluded by contract, including the consumer laws of the country, province or state where you live.
7. Availability of the website
We try to keep the website accurate and available, but we may change, interrupt or stop it at any time. To the extent permitted by law, FitSpotd is not liable for damages resulting from the use of, or the inability to use, the website. This never limits our liability for intentional or gross fault, or for bodily or moral injury, and this section does not apply where the law does not allow it.
8. Spot results and outside services
These rules will also apply to the FitSpotd app and will be repeated in its terms.
- No guarantee of accuracy. Spots are made automatically and can be wrong or incomplete: a result labeled as an exact match may be a different item, and the right item may not be found at all. Product details such as prices, stock, sizes, materials and care instructions come from stores and other websites and may be wrong or out of date. Check the details with the store before you buy.
- We rely on outside services. FitSpotd uses service providers for things like image search, artificial intelligence, hosting and data storage. If one of them has a problem, changes its service or is interrupted, spots may fail, be slower, be less accurate, or be unavailable until the problem is fixed.
- Limits. To the extent permitted by law, FitSpotd is not liable for decisions you make based on a spot, or for failures, delays or interruptions caused by service providers or other events outside our reasonable control. This never limits our liability for intentional or gross fault, or for bodily or moral injury, and it doesn't remove any right you have under consumer protection laws, including any refund the law or the app store's rules give you for a paid feature you couldn't use.
9. Photos you use for spots
These rules apply to the FitSpotd app and will be repeated in its terms.
- Only use photos that you took or have the right to use, and that show clothing, shoes or accessories.
- Never upload nude or sexually explicit images, or any sexual or suggestive image of a minor. Don't upload illegal content, or photos of other people taken or shared without their permission.
- Photos are checked automatically before they're analyzed. Photos that don't show clothing, or that appear to be explicit, are refused and not sent to our service providers. These checks are automatic and can make mistakes.
- We may pause or close an account that breaks these rules, and we will report child sexual abuse material to the authorities as the law requires.
10. Changes to these terms
We may update these terms. We will change the date at the top when we do. Important changes take effect 30 days after we post them. If you keep using the website after a change takes effect, the updated terms apply from then on.
11. Governing law
These terms are governed by the laws of the province of Quebec and the federal laws of Canada that apply there. If you are a consumer, you may also bring a claim before the courts of the place where you live, as the law allows, and you keep the protection of the mandatory laws of the place where you live.
12. General
- We may transfer these terms and the waitlist to a successor, for example a company that takes over FitSpotd or a buyer of FitSpotd, as long as your rights under these terms and our Privacy Policy stay the same.
- If a court finds part of these terms invalid or unenforceable, the rest of the terms still apply.
- If we don't enforce part of these terms right away, we can still enforce it later.
